Данное Пользовательское соглашения регулирует отношения, возникающие между Вами, как физическим лицом (далее: «Пользователь»), и Администрацией интернет-сервиса Terraforming Market (далее: «Администрация») касательно использования Интернет-сервиса Terraforming Market

Неотъемлемой частью настоящего Пользовательского соглашения является Политика конфиденциальности, ознакомиться с которой Вы можете здесь.

1. Термины и определения
Настоящий раздел устанавливает термины и определения, которые будут использоваться в тексте Пользовательского соглашения.

Интернет-сервис Terraforming Market, Сервис – программно-аппаратный комплекс, созданный для осуществления делового общения посредством интернет-сайта, имеющего адрес https://tf-market.com/, а также для объединения представителей делового сообщества по отраслевым, профессиональным, географическим и иным признакам.

Программное обеспечение Интернет-сервиса Terraforming Market – программное обеспечение, размещенное на интернет-сайте, имеющем адрес https://tf-market.com/, обеспечивающее функционирование Интернет-сервиса Terraforming Market и создающее информационные массивы различной тематики, выраженные в виде текстов, графики и т.д.

Пользователь – физическое лицо, достигшее возраста 18 лет, создавшее Учетную запись на Интернет-сервисе Terraforming Market, принявшее настоящее Пользовательское соглашение и использующее Интернет-сервис Terraforming Market в своих целях. Пользователем не может являться лицо, не достигшее возраста 18 лет.

Учетная запись Пользователя – совокупность информации (имя, фамилия, место работы, занимаемая должность т.д.), которая позволяет однозначно идентифицировать Пользователя в процессе использования им Интернет-сервиса Terraforming Market. Учетная запись самостоятельно создается Пользователем путем предоставления сведений о себе. Для получения доступа к своей Учетной записи Пользователь использует сообщенные им при регистрации адрес электронной почты (e-mail) и пароль.

2. Предмет соглашения
В соответствии с настоящим Пользовательским соглашением, Администрация предоставляет Пользователю возможность безвозмездно пользоваться Интернет-сервисом Terraforming Market в порядке и на условиях, определенных настоящим Пользовательским соглашением. Также пользователь вправе за плату воспользоваться дополнительными возможностями Интернет-сервиса Terraforming Market, описанными в соответствующем приложении, являющемся неотъемлемой частью настоящего Пользовательского соглашения.

Настоящее Пользовательское соглашение вступает в силу с момента создания Пользователем Учетной записи.

Создав Учетную запись, Пользователь полностью принимаете условия настоящего Пользовательского соглашения.

ВНИМАНИЕ: если Вы не согласны с каким-либо положением настоящего Пользовательского соглашения, не используйте Интернет-сервис Terraforming Market.

3. Права и обязанности Пользователя
Пользователь Интернет-сервиса Terraforming Market имеет право использовать его в целях эффективного общения с представителями делового сообщества.

Пользователь Интернет-сервиса Terraforming Market обязуется четко выполнять условия настоящего Пользовательского соглашения и любых дополнений к нему.

Пользователь обязуется точно следовать рекомендациям, изложенным в Политике конфиденциальности. Пользователь обязуется сообщить Администрации о любых известных ему ситуациях, которые несут потенциальную угрозу для безопасного функционирования Интернет-сервиса Terraforming Market

Пользователь обязуется незамедлительно уведомить Администрацию о любом случае несанкционированного использования его Учетной записи, а также об известных ему случаях компрометации (утери конфиденциальности) пароля, используемого Пользователем для получения доступа к своей Учетной записи. До момента, когда Администрация получит от Пользователя сообщение о несанкционированном использовании его Учетной записи, либо о компрометации пароля, ответственность за все действия, которые производятся с использованием соответствующей Учетной записи, несет Пользователь.

Пользователь не вправе использовать Интернет-сервис Terraforming Market для распространения экстремистских материалов, выражения неприятия или ненависти к какой-либо религии, культуре, расе, национальности, языку и т.д., распространения угроз насилием или физической расправой, а равно для любой иной незаконной деятельности.

ВНИМАНИЕ: Администрация предупреждает Вас о том, что в случае выявления действий Пользователей, носящих противоправных характер, Администрация незамедлительно обратится в правоохранительные органы с соответствующим заявлением и будет оказывать всяческое содействие в формировании доказательственной базы для дальнейшего ее использования в соответствующих юридических процессах.

Пользователь обязуется предоставлять о себе только достоверную информацию, избегая ее искажения. Использование псевдонимов не допускается.

Пользователь не вправе создавать более одной Учетной записи.

Пользователь обязуется не распространять с использованием Интернет-сервиса Terraforming Market любую конфиденциальную и охраняемую законом информацию о физических либо юридических лицах. Также Пользователь берет на себя обязательство избегать любых действий, в результате которых может быть нарушена конфиденциальность охраняемой законом информации.

Пользователь обязуется внимательно и с должной осмотрительностью использовать Интернет-сервис Terraforming Market, не допуская в процессе его использования нарушения чьих-либо прав на результаты интеллектуальной деятельности.

Пользователь обязуется не использовать Интернет-сервис Terraforming Market для распространения информации рекламного характера иначе как в порядке и на условиях, предусмотренных соответствующим приложением, являющимся неотъемлемой частью настоящего соглашения.

Регистрируясь на ресурсе Terraforming Market, пользователь автоматически соглашается получать коммерческий рекламный текст в составе информационной рассылки, а также иные рассылки рекламного характера.

Пользователь обязуется не предпринимать действий, направленных на причинение вреда программной либо аппаратной части Интернет-сервиса Terraforming Market (распространение вирусных программ, взлом серверов и т.д.)

4. Права и обязанности Администрации Администрация сохраняет конфиденциальность в отношении данных о Пользователе в соответствии с Политикой конфиденциальности, являющейся неотъемлемой частью настоящего Пользовательского соглашения.

Администрация вправе заблокировать Учетную запись Пользователя в случае неисполнения им условий, предусмотренных разделом 3 настоящего Пользовательского соглашения.

ВНИМАНИЕ: Используя Интернет-сервис Terraforming Market Вы соглашаетесь с тем, что Администрация вправе в любой момент без объяснения причин отказать любому Пользователю в доступе к Интернет-сервису Terraforming Market путем блокировки Учетной записи Пользователя. Если Вы не согласны с данным положением Пользовательского соглашения, не используйте Интернет-сервис Terraforming Market

В соответствии с ч. 3 ст. 10.1 Федерального закона от 27.07.2006 № 149-ФЗ «Об информации, информационных технологиях и о защите информации» Интернет-сервис Terraforming Market обязан хранить на территории Российской Федерации информацию о фактах приема, передачи, доставки и (или) обработки голосовой информации, письменного текста, изображений, звуков, видео- или иных электронных сообщений пользователей сети «Интернет» и информацию об этих пользователях в течение одного года с момента окончания осуществления таких действий.

Текстовые сообщения пользователей сети «Интернет», голосовую информацию, изображения, звуки, видео-, иные электронные сообщения пользователей сети «Интернет» необходимо хранить до шести месяцев с момента окончания их приема, передачи, доставки и (или) обработки. Порядок, сроки и объем хранения указанной в настоящем подпункте устанавливаются Правительством Российской Федерации.

5. Исключительные права Все объекты, размещенные на сайте https://tf-market.com/, такие как программное обеспечение, текст, графические изображения, элементы дизайна, скрипты и т.д. являются объектами исключительных прав соответствующих правообладателей.

Размещая на интернет-сайте https://tf-market.com/ объекты исключительных прав, права на которые принадлежат Вам, Вы передаете другим Пользователям неисключительные права на такие объекты. Другие Пользователи имеют право просматривать, копировать и иным образом использовать объекты исключительных прав, принадлежащих Вам, в личных некоммерческих целях. Объекты исключительных прав, к которым получает доступ Пользователь, допускается использовать только в личных некоммерческих целях при условии сохранения всех знаков авторства, а также сохранения имени автора в неизменном виде.

Размещая объекты исключительных прав на сайте https://tf-market.com/, Пользователь управомочивает Администрацию делать копии таких объектов для их публикования на сайте https://tf-market.com/ и резервного хранения.

Интернет-сервис Terraforming Market является открытым информационным ресурсом, наполнение которого осуществляется, в основном, Пользователями. Администрация не производит предварительной проверки информации, передаваемой Пользователями для всеобщего сведения и использования с помощью Интернет-сервиса Terraforming Market и не несет ответственности за достоверность такой информации, а также за нарушения исключительных прав третьих лиц, которые могут допустить Пользователи.

Ни одно из положений настоящего Пользовательского соглашения, а также нескольких положений в совокупности, не может рассматриваться как передача исключительных прав, принадлежащих Администрации, каким-либо лицам.

6. Программное обеспечение Пользуясь Интернет-сервисом Terraforming Market Вы используете программное обеспечение, размещенное на интернет-сайте, имеющем адрес https://tf-market.com/ (далее: «программное обеспечение»). Все права на это программное обеспечение принадлежат Администрации.

Пользователь не вправе использовать программное обеспечение в коммерческих целях. Пользователь не вправе копировать, модифицировать программное обеспечение, разделять его на составные части и использовать их в своих целях.

Права интеллектуальной собственности на содержание и в отношении его, которое не является частью программного обеспечения, но доступ к которому предоставляет программное обеспечение, принадлежат владельцам прав на это содержание и защищены соответствующими законодательными актами. Пользователь не получает никаких прав на использование такого содержания.

7. Ограничение ответственности Администрации Интернет-сервис Terraforming Market постоянно обновляется и дорабатывается Администрацией, в связи с чем Администрация не гарантирует его бесперебойного функционирования, а также того, что данный сервис применим для достижения каких-либо целей или результатов.

Ни при каких обстоятельствах Администрация не несет перед Пользователем ответственности за возможные последствия использования им Интернет-сервиса Terraforming Market

8. Заключительные положения Пользователь соглашается с тем, что все взаимоотношения Пользователя и Администрации в рамках настоящего Пользовательского соглашения регулируются законодательством Российской Федерации

Пользователь соглашается с тем, что Администрация вправе в любой момент в одностороннем порядке изменить условия настоящего Пользовательского соглашения. Использование Интернет-сервиса Terraforming Market после внесения Администрацией изменений в Пользовательское соглашение означает согласие Пользователя с такими изменениями.

This User Agreement regulates the relations arising between you, as an individual (hereinafter: the "User"), and the Administration of the Terraforming Market Internet Service (hereinafter: the "Administration") regarding the use of the Terraforming Market Internet Service

1. Terms and definitions
This section sets out the terms and definitions that will be used in the text of the User Agreement.

The User undertakes to immediately notify the Administration of any unauthorized use of his Account, as well as of known cases of compromise (loss of confidentiality) of the password used by the User to gain access to his Account. Until the moment when the Administration receives a message from the User about the unauthorized use of his Account, or about the compromise of the password, the User is responsible for all actions that are performed using the corresponding Account.
The User does not have the right to use the Terraforming Market Internet service to distribute extremist materials, express rejection or hatred of any religion, culture, race, nationality, language, etc., spread threats of violence or physical violence, as well as for any other illegal activity.
ATTENTION: The Administration warns you that in case of detection of illegal actions of Users, the Administration will immediately apply to law enforcement agencies with a corresponding application and will provide all possible assistance in forming an evidence base for its further use in relevant legal processes.
The User undertakes to provide only reliable information about himself, avoiding its distortion. The use of aliases is not allowed.
The User does not have the right to create more than one Account.
The User undertakes not to distribute any confidential and legally protected information about individuals or legal entities using the Terraforming Market Internet service. The User also undertakes to avoid any actions as a result of which the confidentiality of legally protected information may be violated.
The User undertakes to use the Terraforming Market Internet Service carefully and with due diligence, without allowing anyone's rights to the results of intellectual activity to be violated in the process of using it.
The User undertakes not to use the Terraforming Market Internet Service for the dissemination of advertising information, except in accordance with the procedure and under the conditions provided for in the relevant annex, which is an integral part of this agreement.

8. Final provisions The User agrees that all relations between the User and the Administration within the framework of this User Agreement are regulated by the legislation of the Russian Federation
The User agrees that the Administration has the right to unilaterally change the terms of this User Agreement at any time. The use of the Terraforming Market Internet service after the Administration has made changes to the User Agreement means that the User agrees to such changes.

Este Acuerdo de Usuario entra en vigor desde el momento en que el Usuario crea una Cuenta.
Al crear una cuenta, el usuario acepta plenamente los términos de este acuerdo de usuario.
ATENCIÓN: si no está de acuerdo con alguna disposición de este Acuerdo de usuario, no utilice el servicio de Internet de Terraforming Market.

3. Derechos y obligaciones del Usuario
El usuario del servicio de Internet de Terraforming Market tiene derecho a utilizarlo con el fin de comunicarse eficazmente con representantes de la comunidad empresarial.
El usuario del Servicio de Internet de Terraforming Market se compromete a cumplir estrictamente con los términos de este Acuerdo de usuario y cualquier adición al mismo.
El Usuario se compromete a seguir estrictamente las recomendaciones recogidas en la Política de Privacidad. El Usuario se compromete a informar a la Administración de cualquier situación de su conocimiento que suponga una amenaza potencial para el funcionamiento seguro del servicio de Internet de Terraforming Market.
El Usuario se compromete a notificar inmediatamente a la Administración de cualquier uso no autorizado de su Cuenta, así como de los casos conocidos de compromiso (pérdida de confidencialidad) de la contraseña utilizada por el Usuario para acceder a su Cuenta. Hasta el momento en que la Administración reciba un mensaje del Usuario sobre el uso no autorizado de su Cuenta, o sobre el compromiso de la contraseña, el Usuario es responsable de todas las acciones que se realicen utilizando la Cuenta correspondiente.
El Usuario no tiene derecho a utilizar el servicio de Internet de Terraforming Market para distribuir materiales extremistas, expresar rechazo u odio hacia cualquier religión, cultura, raza, nacionalidad, idioma, etc., difundir amenazas de violencia o violencia física, así como para cualquier otra actividad ilegal.
ATENCIÓN: La Administración advierte que en caso de detección de acciones ilícitas de los Usuarios, la Administración se dirigirá de inmediato a las fuerzas del orden con la solicitud correspondiente y brindará toda la asistencia posible en la conformación de una base probatoria para su posterior uso en los procesos legales pertinentes.
El Usuario se compromete a proporcionar únicamente información fidedigna sobre sí mismo, evitando su distorsión. No se permite el uso de alias.
El usuario no tiene derecho a crear más de una cuenta.
El Usuario se compromete a no distribuir ninguna información confidencial y legalmente protegida sobre personas físicas o jurídicas que utilicen el servicio de Internet de Terraforming Market. El Usuario también se compromete a evitar cualquier actuación que pueda vulnerar la confidencialidad de la información legalmente protegida.
El Usuario se compromete a utilizar el Servicio de Internet de Terraforming Market de forma cuidadosa y con la debida diligencia, sin permitir que se vulneren los derechos de nadie sobre los resultados de la actividad intelectual en el proceso de utilización del mismo.
El Usuario se compromete a no utilizar el Servicio de Internet de Terraforming Market para la difusión de información publicitaria, salvo de conformidad con el procedimiento y en las condiciones previstas en el anexo correspondiente, que forma parte integrante de este contrato.
Al registrarse en el recurso Terraforming Market, el usuario automáticamente acepta recibir un texto publicitario comercial como parte de un boletín informativo, así como otros boletines publicitarios.
El Usuario se compromete a no realizar acciones destinadas a dañar el software o hardware del servicio de Internet Terraforming Market (distribución de programas antivirus, piratería de servidores, etc.)

4. Derechos y obligaciones de la Administración La Administración mantiene la confidencialidad con respecto a los datos del Usuario de acuerdo con la Política de Privacidad, que es parte integral de este Acuerdo de Usuario.
La Administración tiene derecho a bloquear la Cuenta del Usuario en caso de incumplimiento de las condiciones previstas en el apartado 3 de este Acuerdo de Usuario.
ATENCIÓN: Al utilizar el Servicio de Internet de Terraforming Market, usted acepta que la Administración tiene el derecho de rechazar el acceso de cualquier Usuario al Servicio de Internet de Terraforming Market en cualquier momento sin explicar las razones bloqueando la Cuenta de usuario. Si no está de acuerdo con esta disposición del Acuerdo de usuario, no utilice el servicio de Internet de Terraforming Market.

El procedimiento, las condiciones y el volumen de almacenamiento especificados en este subpárrafo los establece el Gobierno de la Federación de Rusia.

El Usuario acepta que la Administración tiene el derecho de cambiar unilateralmente los términos de este Acuerdo de Usuario en cualquier momento. El uso del servicio de Internet de Terraforming Market después de que la Administración haya realizado cambios en el Acuerdo de usuario significa que el Usuario acepta dichos cambios.
